Rosh Drive – Terms and Conditions

These Terms and Conditions ("Terms") govern the use of Rosh Drive, a software platform developed to assist driving instructors in managing lessons, student bookings, records, payments, and overall reputation-building. By accessing or using Rosh Drive ("Software"), you agree to comply fully with these Terms. If you do not accept these Terms, you must refrain from using the Software. These Terms supersede any prior agreements, communications, or arrangements between you and Rosh Drive regarding the services offered.

1. Definitions

1.1 "Rosh Drive" or "Software" refers to the digital platform enabling instructors to teach, track, and manage driving lessons and related operations.

1.2 "Instructor" refers to licensed individuals or organizations who subscribe to and use Rosh Drive for managing students and lessons.

1.3 "Student" refers to any learner whose details, progress, and bookings are recorded through the Software.

1.4 "Services" include but are not limited to student booking management, lesson tracking, record storage, payment handling, and analytics provided by the Software.

1.5 "Account" means the personalized profile created by the Instructor to access the Software.

2. Eligibility

2.1 Instructors must be legally licensed to conduct driving lessons in their jurisdiction.

2.2 Users must be at least eighteen (18) years old to create an account and access paid features.

2.3 By using Rosh Drive, you confirm that you have the authority to bind yourself or your business entity to these Terms.

3. Account Registration

3.1 Instructors must provide accurate personal and professional details during registration.

3.2 You are responsible for safeguarding login credentials and all activities under your account.

3.3 Misrepresentation of identity, licensing, or qualifications will result in suspension or termination of services.

4. Use of Software

4.1 The Software must be used solely for driving instruction and related administrative purposes.

4.2 You may not misuse the platform for fraudulent, illegal, or unrelated commercial activities.

4.3 Unauthorized copying, modification, or reverse engineering of the Software is prohibited.

5. Student Bookings

5.1 Instructors are responsible for accurately recording, confirming, and managing lesson bookings.

5.2 The Software provides organizational tools but does not guarantee student attendance or punctuality.

5.3 Cancellation and rescheduling policies are set by the Instructor and must comply with local regulations.

6. Record Storage

6.1 Rosh Drive allows Instructors to store student records, lesson progress, and payment history for up to three (3) years.

6.2 Instructors are responsible for exporting or backing up important data before expiry.

6.3 Rosh Drive is not liable for data loss caused by failure to back up or export records.

7. Payment Handling

7.1 Instructors may use the Software to manage student payments and track outstanding fees.

7.2 Payment collection responsibility remains with the Instructor, unless integrated with approved third-party gateways.

7.3 Disputes between Instructors and Students regarding payments are outside the liability of Rosh Drive.

8. Data Privacy

8.1 Personal information of Students and Instructors is handled in compliance with applicable data protection laws.

8.2 Rosh Drive will not sell or misuse personal data, except as required by law or consented by the Instructor.

8.3 Instructors are responsible for ensuring their own use of Student data complies with local privacy requirements.

9. Software Updates

9.1 Rosh Drive may introduce updates, patches, or new features without prior notice.

9.2 Instructors must update the Software regularly to ensure smooth operation and access to the latest features.

9.3 Failure to update may result in limited functionality or security vulnerabilities.

10. Instructor Obligations

10.1 Instructors are responsible for verifying that their licenses remain valid while using the Software.

10.2 Rosh Drive does not validate or certify driving instructors; compliance with legal requirements is the Instructor’s responsibility.

10.3 Misuse or misrepresentation may result in account termination.

11. Intellectual Property

11.1 All rights, titles, and interests in the Software remain the sole property of Rosh Drive.

11.2 You are granted a non-exclusive, non-transferable license to use the Software for professional purposes only.

11.3 Unauthorized reproduction or distribution of the Software may result in legal action.

12. Limitation of Liability

12.1 Rosh Drive is not responsible for accidents, losses, or damages arising from driving lessons conducted by Instructors.

12.2 The Software is provided "as is" without warranties of uninterrupted service, fitness for a particular purpose, or error-free operation.

12.3 Rosh Drive will not be liable for indirect, incidental, or consequential damages.

13. Termination

13.1 Instructors may terminate their account at any time by ceasing use of the Software.

13.2 Rosh Drive reserves the right to suspend or terminate accounts in cases of breach of these Terms.

13.3 Upon termination, all rights to use the Software are immediately revoked.

14. Governing Law

14.1 These Terms are governed by the laws of Sri Lanka.

14.2 Any disputes will be subject to the exclusive jurisdiction of the courts of Sri Lanka.

15. Amendments

15.1 Rosh Drive reserves the right to revise these Terms at any time, with updates posted on the official platform.

15.2 Continued use of the Software after revisions constitutes acceptance of the updated Terms.

15.3 Instructors are advised to review Terms periodically to remain informed of changes.
